Ruling marks Impotence as 10 Percent Loss of Earning Power

In a landmark ruling, a court has recognized permanent impotence
resulting from a car accident as a loss of earning power.
A 44-year-old man identified by his surname Lee was sitting on
the side of one-lane road in Anseong, Gyeonggi Province in September
1999 when he was hit by a van. The accident got him a severed urethra
and consumed 16 weeks of treatment leaving him permanently impotent.
The Seoul High Court found for Lee in a suit for damages and medical
costs against the offender's insurance company.
The court ordered the insurers to pay Lee W148 million (US$148,000)
in costs and damages, ruling that sexual
dysfunction from permanent impotence can have a negative impact
on a man's will to live on the psychological, emotional and physical
level.
The court set loss of earning power from Erectile
Dysfunction at 10 percent.
